What Happens If You Settle Your Workers Compensation Claim?

Good afternoon, Dr. Calabrese here at Medical Care of Western New York. Many questions have been asked to me about workman’s comp and no-fault. I try to filter through those questions and give you some good advice. One question that’s always asked about workman’s compensation injuries is what happens if I settle my claim? Well, if you’ve reached your maximum medical improvement, then settlement is in order. If it’s one year out post-surgically, or two years out without surgery, Section 32 is where you would settle.

You could settle with or without medical insurance. I always advise my patients to settle Section 32 with medical, therefore they can improve their structure and function as time goes on. Thank you and have a good day.
